Breaking News: The Harvard faculty chapter of the American Association of University Professors (AAUP), along with the national organization, has filed a lawsuit against the Trump administration challenging a review of nearly $9 billion in federal funding. The lawsuit alleges political bias, violations of the First Amendment and Title VI of the Civil Rights Act, and seeks a temporary restraining order to block the administration from cutting off Harvard University’s federal funding.

The Core of the Dispute

The lawsuit argues that the review, initiated after announcements from the departments of Education, Health and Human Services, and the US General Services Administration that they are reviewing $8.7 billion in grants and more than $255 million worth of contracts between Harvard, its affiliates and the federal government, is based on politically motivated demands rather than objective assessments of research merit. The professors claim the review targets specific academic policies and programs at Harvard, including diversity, equity, and inclusion (DEI) initiatives, and demands that clash with academic freedom and civil rights protections.

Key Arguments in the Lawsuit

  • Political Bias: The lawsuit explicitly accuses the Trump administration of operating with a pre-determined agenda influenced by partisan politics, demanding policy changes aligned with the administration’s preferred viewpoints.
  • Threat to Academic Freedom and Free Speech: The professors assert that the review infringes upon academic freedom by discouraging research and expression in areas deemed controversial by the administration. They argue that demands such as a ban on masks at campus protests violate free speech principles.
  • Violation of Civil Rights Act: The lawsuit alleges the Trump administration’s actions violate Title VI of the Civil Rights Act, which prohibits discrimination under federally assisted programs on grounds of race, color or national origin.
  • Financial Impact: The potential loss of $9 billion in federal funding would severely impact Harvard’s research capabilities, faculty recruitment, and overall academic standing, potentially halting life-saving research and imperiling important scientific research and innovation.

Executive branch officials cannot coerce a private university into suppressing academic freedom and free speech, the lawsuit says, “by leveraging the vast financial power of the federal government to effectively put ‘a gun to the head’ of a private university.”

The complaint against the Trump administration’s review says its actions have “already caused severe and irreparable harm by halting academic research and inquiry at Harvard, including areas that have no relation whatsoever to charges of antisemitism or other civil rights violations.”

“Harvard faculty have the constitutional right to speak, teach, and conduct research without fearing that the government will retaliate against their viewpoints by canceling grants,” Crespo said.

Harvard’s Response

Harvard University President Alan Garber has stated that if the funding were revoked, it would “halt life-saving research and imperil important scientific research and innovation.” The university maintains that it adheres to the highest standards of research integrity and that its funding applications are based on rigorous scientific merit.

“Harvard is committed to fostering an environment where academic freedom thrives,” the statement reads. “We stand by our faculty and will vigorously defend their right to conduct research without undue political interference.”

Echoes of Columbia University

The lawsuit points to the Trump administration’s previous actions against Columbia University, where $400 million in federal funding was cut, leading to policy changes by the university. The professors argue that the current review of Harvard’s funding signals a similar imminent threat.

Demands from the Trump Administration

According to the lawsuit and reports, the demands outlined in the letter from the federal task force include the elimination of Harvard’s diversity, equity and inclusion programs, a ban on masks at campus protests, and “full cooperation” with the Department of Homeland Security and federal regulators to ensure “full compliance.”

Next Steps

The court is expected to hear arguments on the request for a temporary restraining order in the coming weeks. Legal experts anticipate a lengthy and complex legal battle, with potential appeals to higher courts. This is a developing story, and further updates will be provided as they become available.

The case is being closely watched by academic institutions, legal scholars, and political observers alike. The outcome will likely shape the future of federal research funding and the relationship between government and academia.
